This notice explains how the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq., applies to IDLeakCheck and to your use of our Service. It supplements, and is incorporated into, our Terms of Service.
We are not a consumer reporting agency
IDLeakCheck is not a "consumer reporting agency" ("CRA") as that term is defined in 15 U.S.C. § 1681a(f). We do not assemble or evaluate consumer credit information or other information on consumers for the purpose of furnishing consumer reports to third parties.
Our information is not a "consumer report"
The information made available through the Service is not a "consumer report" as defined in 15 U.S.C. § 1681a(d). Our data is compiled from publicly available sources, breach corpora, and proprietary records for general-purpose informational use. We do not verify it for, and it is not intended to be used in, any credit, employment, insurance, or other FCRA-regulated decision.
Prohibited uses
You may not use information obtained through IDLeakCheck — in whole or in part, alone or in combination with other information — to make, support, or influence any of the following decisions, which are governed by the FCRA at 15 U.S.C. § 1681b:
- Credit or insurance to be used primarily for personal, family, or household purposes;
- Employment purposes, including hiring, retention, promotion, reassignment, or termination;
- Tenant screening, rental decisions, or housing eligibility;
- Education, including school admissions or scholarship eligibility;
- A license or other benefit granted by a governmental agency;
- Underwriting of insurance involving the consumer;
- A legitimate business need for a transaction initiated by the consumer (when that transaction would otherwise require a consumer report);
- Determining eligibility for an account with a financial institution;
- Use by the consumer's child-support enforcement agency;
- Use by an executive department or agency for counter-terrorism, counter-intelligence, or other national-security purposes;
- Any other purpose listed in 15 U.S.C. § 1681b.
This list is not exhaustive. If you are uncertain whether your intended use is permitted, you must not use IDLeakCheck for that purpose.
What this means for you
When you sign up, search, unlock a profile, or use our API, you affirm that you will not use any IDLeakCheck information for any FCRA-regulated purpose. This affirmation is binding under our Terms of Service and may be enforced by us, by you, by affected consumers, and by federal and state regulators.
If you need an FCRA-compliant report
For any FCRA-regulated decision — including pre-employment background screening, tenant screening, credit decisioning, or insurance underwriting — you must obtain a consumer report from a licensed consumer reporting agency that complies with the FCRA, including providing pre-adverse-action and adverse-action notices to the consumer where required. IDLeakCheck does not offer this service and cannot become one through any combination of API usage or customer attestations.
Consequences of misuse
Use of the Service for any FCRA-regulated purpose is a material breach of our Terms of Service and may also violate federal law. We may, without notice, suspend or terminate your account, revoke API keys, retain or refund payments at our sole discretion, and cooperate with regulators and affected consumers in any resulting investigation or enforcement action. The FCRA provides for actual damages, statutory damages, punitive damages for willful violations, and attorneys’ fees recoverable by affected consumers (15 U.S.C. §§ 1681n, 1681o).
Reporting suspected misuse
If you believe IDLeakCheck information was used to make an adverse decision about you in violation of this notice, please contact us through our Data Removal & Requests form. We will investigate and, where appropriate, refer the matter to enforcement authorities.
Changes to this notice
We may update this notice from time to time. Material changes will be announced at least 30 days in advance via email to account holders and via an in-product banner. The version of this notice in effect at the time you used the Service generally governs that use.
